Acceptance of these terms

These Terms of Use apply whenever you access or use Firecast. By using the site, you agree to these terms. If you do not agree, do not use the site.

Fire data can be wrong or late

Firecast relies on information obtained from government agencies—including the National Interagency Fire Center (NIFC)—and other third-party sources. Firecast does not control this source data. Fire locations, acreage, containment, boundaries, names, discovery dates, and update times may be delayed, incomplete, estimated, duplicated, inaccurate, or later revised. Processing, transmission, and display errors may introduce additional inaccuracies.

Firecast does not guarantee that:

• every active fire will appear;
• displayed locations, distances, or boundaries are exact;
• any information is current, accurate, or complete;
• a location shown outside a fire area is safe; or
• a fire’s absence from Firecast means no fire, smoke, or other danger exists.

Conditions can change faster than data can be collected or displayed. Always verify information with official, current local sources before acting.

No warranties

To the maximum extent permitted by law, Firecast and all information available through it are provided “as is” and “as available,” without warranties of any kind, express or implied. This includes warranties of accuracy, completeness, timeliness, availability, reliability, noninfringement, merchantability, fitness for a particular purpose, safety, or uninterrupted or error-free operation. Firecast does not warrant that defects will be corrected or that the site will be free of harmful components.

Limitation of liability

To the maximum extent permitted by law, Firecast will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive loss or damage arising from or related to Firecast or your use of—or inability to use—the site. This exclusion includes losses arising from:

• reliance on fire information;
• missing, delayed, incomplete, or inaccurate data;
• evacuation, travel, property, business, health, or safety decisions;
• injury, death, property damage, lost profits, lost data, or business interruption;
• website outages, transmission problems, or other technical failures; or
• third-party services, data, maps, websites, or external links.

These limitations apply regardless of the theory of liability and even if the possibility of loss was known. Nothing in these terms excludes or limits liability that applicable law does not allow to be excluded or limited. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so portions of this section may not apply to you.

Acceptable use

You may not:

• interfere with, disrupt, disable, or overload Firecast;
• scrape or access the service through automated means contrary to published rules or technical restrictions;
• attempt unauthorized access to systems, data, accounts, or networks;
• introduce malware or other harmful code;
• misrepresent Firecast data as an official emergency alert or official government information; or
• use Firecast unlawfully or to facilitate unlawful conduct.

Intellectual property and public data

Government fire data remains subject to the originating agency’s terms, attribution requirements, licensing, or public-domain status. These terms do not claim ownership of that source data.

Firecast’s original software, branding, layout, graphics, analysis, and compiled presentation are owned by Firecast or its licensors and are protected by applicable intellectual-property laws. No rights are granted except the limited right to use the site under these terms.

Third-party services

Firecast may use or link to third-party websites, maps, analytics services, infrastructure, and data providers. Firecast does not control and is not responsible for their content, availability, accuracy, security, privacy practices, or terms. Your use of a third-party service is governed by that service’s own terms and policies.

Changes and availability

Firecast may update, suspend, modify, restrict, or discontinue any part of the site at any time without notice. These terms may also be revised. Material changes will be reflected by an updated effective date. Continued use after revised terms take effect means you accept them.

Applicable law

These terms are governed by applicable law, without regard to conflict-of-law principles. Any dispute must be brought in a court with lawful jurisdiction and proper venue. Nothing in these terms deprives you of mandatory protections or venue rights provided by the law where you live.

Severability and entire agreement

If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in effect. These terms, together with the Privacy Policy, are the entire agreement concerning use of Firecast.
